Agreement to Terms
By accessing, engaging, or using services provided by Insight Arbor (“Company,” “we,” “our,” or “us”), you (“Client,” “you,” or “your”) agree to these Terms of Service (“Terms”).
If you do not agree to these Terms, please do not use our services.
Acceptance of a written proposal, signed agreement, scheduling confirmation, or payment for services constitutes acceptance of these Terms and the associated scope of work.
Services
Insight Arbor provides professional arboricultural consulting services, including but not limited to:
• Arborist reports and written consulting documentation
• Tree risk assessment and hazard evaluation
• Tree preservation and protection planning
• Construction and development consulting
• Tree inventory and GIS-integrated mapping
• Oak ordinance and permitting review
• Defensible space and vegetation consultation
• Ongoing monitoring and site consultation
• General arboricultural consulting services
Professional Standards
Services are performed in accordance with recognized arboricultural industry standards, accepted professional practices, and the professional judgment of the consulting arborist at the time services are provided.
Recommendations and findings are based on observed site conditions, available information, and conditions reasonably apparent during the time of inspection.
Client Responsibilities
Clients agree to:
• Provide accurate project and property information
• Provide safe and reasonable site access
• Disclose known hazards or relevant site conditions
• Obtain required permits, approvals, or agency authorizations unless otherwise agreed in writing
• Review and communicate any project changes that may affect scope or deliverables
• Pay invoices in accordance with agreed terms
Limitations of Services
Unless otherwise stated in writing, assessments are visual and non-invasive in nature.
Services generally do not include:
• Internal decay testing
• Subsurface investigation
• Laboratory analysis
• Root excavation
• Climbing inspections
• Aerial inspection
• Engineering analysis
unless specifically identified within the written scope of work.
Trees and natural systems are living organisms subject to change. Insight Arbor does not guarantee future tree condition, structural performance, survival, or failure potential.
Professional Opinions and Recommendations
All reports, assessments, recommendations, and consulting opinions reflect professional judgment based on conditions observed at the time of service.
Recommendations are intended to assist clients, property owners, agencies, contractors, or related parties in decision-making but should not be interpreted as guarantees, warranties, or predictions of future conditions.
Payment Terms
Fees and payment schedules will be identified within written proposals, invoices, or service agreements.
Unless otherwise stated:
• Payment is due within 30 days of invoice date
• Outstanding balances may incur a 1.5% monthly finance charge or the maximum amount permitted by law
• Clients are responsible for reasonable collection costs associated with unpaid balances
Insight Arbor reserves the right to withhold reports, deliverables, recommendations, GIS data, maps, exhibits, or project documentation until payment is received in full.
Cancellations and Rescheduling
Scheduled site visits or consultations canceled with less than 24 hours notice may be subject to cancellation or rescheduling fees.
Completed professional services, performed site visits, consultations, and delivered materials are non-refundable.
Limitation of Liability
Insight Arbor maintains applicable professional and general liability insurance coverage.
To the maximum extent permitted by law, Insight Arbor’s liability arising from services provided shall be limited to the amount paid by the client for those services.
Insight Arbor shall not be liable for:
• Indirect, incidental, or consequential damages
• Weather events, environmental conditions, or acts of nature
• Changes in tree condition occurring after inspection
• Hidden, subsurface, or otherwise undiscoverable conditions
• Actions taken or not taken by third parties
• Failure to implement recommendations
No Warranty
Services are provided based on professional judgment and are offered without express or implied warranties, including warranties of merchantability or fitness for a particular purpose.
Intellectual Property
All reports, written findings, maps, exhibits, graphics, photographs, GIS data, and related professional materials prepared by Insight Arbor remain the intellectual property of the Company unless otherwise agreed in writing.
Clients are granted limited use of deliverables for the specific project or property for which services were provided. Materials may not be reproduced, modified, distributed, or reused for unrelated purposes without prior written permission.
Confidentiality
Insight Arbor respects the confidentiality of client information and project-related materials. Information obtained during the course of services will not be disclosed to third parties except:
• With client authorization
• As required by law
• As necessary for professional, regulatory, or legal compliance
Safety
Clients acknowledge that trees and natural systems involve inherent and unpredictable risk.
While reasonable efforts are made to identify visible concerns and provide informed recommendations, Insight Arbor cannot eliminate all potential hazards associated with trees, weather events, or changing site conditions.
Emergency situations involving immediate threats to life or property should be directed to emergency services before contacting Insight Arbor.
Dispute Resolution
The parties agree to first attempt good-faith resolution of any dispute arising from services provided.
If resolution cannot be reached, disputes shall be resolved through binding arbitration conducted in California in accordance with applicable arbitration rules.
Governing Law
These Terms shall be governed and interpreted under the laws of the State of California, United States.
Modifications to Terms
Insight Arbor reserves the right to modify these Terms periodically. Updated versions will be posted on the website with a revised effective date.
Continued use of services following updates constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with any written proposal, estimate, invoice, or service agreement, constitute the complete agreement between Insight Arbor and the Client and supersede prior discussions or understandings relating to the services provided.
